An overview of GemShip's, as well as other services provided by GemShip, (hereinafter collectively referred to as the "Service") Privacy Policy is below. This Privacy Policy (hereinafter referred to as the "Policy") applies to the handling of user information, including personal information, of all users of GemShip (hereinafter referred to as "Customer"), and other Services provided by Gemship.

ARTICLE I. COMPLIANCE WITH LAWS AND REGULATIONS

Our Company thoroughly recognize the importance of protecting personal information. In order to realize this, the Company shall strictly comply with the Act on the Protection of Personal Information (Act No. 57 of 2003; hereinafter referred to as the "Personal Information Protection Act;" "PIPA"), government guidelines, and other related laws and regulations.

ARTICLE II. COLLECTION OF USER INFORMATION (SCOPE AND METHOD)

The term "User Information," with respect to this Policy, shall pertain to information related to the Customer while using our Service: their identification, activity history on their communication service, information concerning ingoing/outgoing e-mails, and other information generated and/or stored by the Customer on their smartphone, computer, or other devices, and shall be properly handled by the Company in accordance with the Policy.

ARTICLE III. MANAGEMENT OF INFORMATION

  1. In order to keep User Information accurate and up-to-date, and, to prevent unauthorized access, loss, damage, falsification, leakage, etc. of this User Information, the Company will maintain a security system as well as develop a management system, and thoroughly train employees. The Company will ensure that safety measures are well implemented and User Information are strictly managed to safeguard such information thereof. In the event that the Company outsources, in whole or in part, the handling of this personal information, the Company will conduct necessary and appropriate supervisions to ensure that the outsourced company securely manages these personal information.

  11. To serve purposes related to the function and uses described in the preceding items.

ARTICLE V. CHANGES TO PURPOSE OF USE SURROUNDING USER INFORMATION

The Company may amend the Purpose of Use related to User Information in a manner deemed to be reasonably relevant. In the event that such changes are made, the Company will notify Customers or issue a public announcement.

ARTICLE VI. DEFINITION OF PERSONAL INFORMATION

Personal Information in this Policy shares its meaning as defined in the Act on the Protection of Personal Information (Article 2, Section 1): means information relating to a living individual to whom contains a name, date of birth, or other description/s, etc. whereby a specific individual can be reasonably identified (including those which can be readily collated with other information and thereby identify a specific individual).

ARTICLE VII. LIMITATIONS ON USE OF PERSONAL INFORMATION

The Company will not handle Personal Information for purposes beyond the necessary scope of use without the Customer’s prior consent, and will use Personal Information as permitted by relevant laws and regulations. However, the aforementioned restriction shall not apply in the following cases:

  1. When stipulated by law and/or regulations;
  2. When an individual's life, health, or property damage is at risk and obtaining the Customer's prior consent may prove to be difficult;
  3. When it is necessary for improving public health or promoting the sound development of children and obtaining the Customer's prior consent may prove to be difficult;
  4. When cooperation with a government organization, local government body, or individual entrusted by such entities in performing duties prescribed by laws and regulations is necessary, and obtaining the Customer's consent may interfere with or risk the execution of such affairs thereof;
  5. When the Company discloses your personal information to a lawyer or other party, which are obligated to exercise confidentiality, for provisions deemed necessary for the Service.

ARTICLE VIII. PROVISION OF PERSONAL INFORMATION TO THIRD PARTIES

The Company will not provide personal information to third parties without the Customer’s prior consent, and will use Personal Information as permitted by relevant laws and regulations. However, this shall not apply in the following cases:

  1. When the Company outsources, in whole or in part, the handling of this Personal Information to a subcontractor (located in his/her country of residence or another region), for purposes deemed necessary. In the event that the Company outsources such service, the Company will conduct necessary and appropriate supervisions to ensure that the outsourced company properly handles our furnished Personal Information;
  2. In cases wherein provision of Personal Information is a result of the succession of business due to a merger, consolidation, or other related reasons;
  3. When cooperation with a government organization, local government body, or individual entrusted by such entities in performing duties prescribed by laws and regulations is necessary, and obtaining the Customer's consent may interfere with or risk the execution of such affairs thereof;
  4. For disclosure or provision of Personal Information to an outsourced third party for research and analysis purposes of the Service, all conducted within the scope allowed by laws or regulations;
  5. When enlisting third party services related to our advertising operations, providing them with historical information, cookie information, and advertising identifiers, and, which require the use of cookies to effectively determine which advertisements, information, and services are to be published or offered to users; Cookie 情報、広告識別子を提供する場合

ARTICLE IX. DISCLOSURE OF PERSONAL INFORMATION

When the Company receives a request for disclosure of a Customer's Personal Information, in accordance with the Personal Information Protection Law, the Company shall respond promptly to the request after confirming the Customer made such disclosure himself/herself; the Company shall also notify the Customer in the event that such Personal Information does not exist. However, this does not apply to cases in which the Company is under no obligation to disclose information pursuant to the Personal Information Protection Act or other laws and regulations.

ARTICLE X. CORRECTION, CESSATION, ETC. OF USE OF PERSONAL INFORMATION

  1. In accordance with the Personal Information Protection Act, If a Customer requests (1) correction of Personal Information because it is incorrect or inaccurate, or (2) cessation of use of his/her Personal Information because it has been used for purposes beyond the scope of those previously stipulated or because it has been collected through deceptive or other wrongful means, the Company will conduct necessary investigations promptly upon confirmation of the customer's request, and, based on the results of the investigation, correct or suspend use of the Personal Information, and notify the customer to that effect. If the Customer requests the suspension of the use of his/her personal information, the Company shall promptly look into his/her request after confirming such request has been made by the Customer himself/herself. If the Company has decided not to correct or suspend the use of personal information based on reasonable grounds, we will notify the Customer to that effect. However, this shall not apply in cases where the Company is under no obligation to suspend the use of Personal Information under the Personal Information Protection Act or, other laws and regulations.
  2. If the Company deems it necessary to fulfill the Customer's request to correct or suspend the use of personal information based on reasonable grounds, the Company shall promptly fulfill his/her request after confirming such request has been made by the Customer himself/herself, and will notify the customer to that effect. However, this shall not apply in cases where the Company is under no obligation to suspend the use of Personal Information under the Personal Information Protection Act or, other laws and regulations.

ARTICLE XI. SERVICE POST-TERMINATION, HANDLING OF INFORMATION

In accordance with this Policy, the Company may continue to store and handle user information, that the Company have acquired up to the point of its termination, even after the Service ceases to exist.

ARTICLE XII. USE OF COOKIES AND OTHER TECHNOLOGIES

When we provide our Service, the Company may use cookies and other similar technologies in order to understand how our Customers use the Service and help improve the Service. Customers who wish to disable their cookies may do so by accessing and changing the setting on their web browsers. If, however, the Customer deactivate cookies or limit the ability to set cookies, some functions related to the furnishing of our Service may not be available.
